Data Privacy Framework Notice

This Data Privacy Framework Notice supplements the Privacy Policy of Korrus, Inc., a Delaware corporation, and its subsidiaries Tempo Lighting, LLC, a Delaware limited liability company and Ecosense Lighting, LLC, a Delaware limited liability (collectively, “Korrus”). Our Privacy Policy is where you will find details about the types of personal data we collect, the purpose for which we collect and use personal data, the type of third parties to which we disclose personal information, and the purposes for which we do so, your rights to access your personal data, and the choices and means we offer you for limiting the use and disclosure of your personal data.

Certification

Ecosense comply with the EU-U.S. Data Privacy Framework program (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (“Swiss-U.S. DPF,” and together with the EU-US DPF and the UK Extension to the EU-U.S. DPF, the “Data Privacy Frameworks”) as set forth by the U.S. Department of Commerce. Ecosense has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Ecosense has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Data Privacy Framework Notice and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Inquiries and Dispute Resolution

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Ecosense commits to resolve DPF Principles-related complaints about our collection and use of your personal data. EU and UK individuals and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-DPF should first contact Ecosense at: support@ecosenselighting.com or (855) 632-6736 or 843 N Spring Street, Suite 404 Los Angeles 90012.

Ecosense has further committed to refer unresolved privacy complaints under the Data Privacy Frameworks to a U.S.-based independent dispute resolution mechanism, the BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.

U.S. Federal Trade Commission Enforcement

The Federal Trade Commission has jurisdiction over Ecosense’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

Onward Transfer

As explained in our Privacy Policy, Ecosense sometimes provides personal data to third parties to perform services on our behalf. If we transfer personal data received under the Data Privacy Frameworks to a third party, the third party’s access, use, and disclosure of such personal data must also be in compliance with our Data Privacy Frameworks obligations, and we will remain liable under the Data Privacy Frameworks for any failure to do so by the third party unless we prove we are not responsible for the event giving rise to the damage.
